Drop-in booking terms

These terms apply when you book or attend an online swimming coaching drop-in with me. Please read them before booking. If anything is unclear, ask me before you pay.
1. Who provides the session?
I am James Nock, a sole trader providing the session in a personal capacity as an independent swimming coach.

My advice and opinions are my own. They do not represent any swimming club, employer, governing body, Swim England or other organisation.
2. What you are booking
A drop-in is a 25-minute online session held using Zoom, unless we agree another platform. It provides swimming coaching, education, mentoring and general guidance for swimmers and/or their parents or guardians. The session details, date, time and total price are shown before you confirm the booking.
A session is not a replacement for the swimmer's regular coach. Recommendations are optional, and swimmers, parents and regular coaches remain responsible for deciding whether to follow them. I encourage you to discuss recommendations openly with the swimmer's regular coach.
3. Who can book?
You must be at least 18 years old to make a booking. Where the swimmer is under 18, a parent or legal guardian must make the booking and attend the session. I may refuse or end a session if this safeguarding requirement is not met.
4. Booking and payment
Payment is due in advance through the booking system unless we agree otherwise. Your booking is confirmed when you receive the booking confirmation. GetItBooked provides the booking system and Stripe processes card payments. I do not receive your complete card details.
Please check the name, email address, date and time before confirming. Tell me promptly if your confirmation is incorrect or does not arrive.
5. Cancellations, rearrangements and missed sessions
- If you give at least 48 hours' notice before the scheduled start time, you may choose a full refund or one rearrangement without an additional charge.
- If you give less than 48 hours' notice, the booking is non-refundable and there is no automatic right to a free rearrangement.
- A missed session without notice is non-refundable.
- Joining late will not normally extend the scheduled finishing time.
To cancel or rearrange, use the cancellation facility in your booking confirmation or email [email protected].
If I have to cancel, I will offer a rearranged session or a full refund. I am not responsible for other costs resulting from a cancellation. Nothing in this section limits any cancellation or refund right you have under consumer law; where a statutory right applies, it takes priority over this policy.
6. Technology problems
You are responsible for having a suitable device, internet connection and a quiet place to join the session. If a technical problem on my side prevents the session from taking place, I will offer a rearrangement or refund. If the problem is on your side, I will make a reasonable attempt to continue or reconnect, but the missed-session terms may apply if the session cannot proceed.
7. Coaching outcomes
Advice is based on the information provided during the session and my professional coaching experience. Every swimmer is different. I cannot guarantee improved performance, selection, qualification times, personal bests or competition results. Outcomes depend on many things outside my control, including commitment, health, development, attendance, the training environment and coaching received elsewhere.
8. Health and medical matters
I may make general coaching observations about health, nutrition, injury prevention, recovery or mental wellbeing. I am not acting as a doctor, physiotherapist, dietitian, nutritionist, psychologist or other healthcare professional, and those observations are not medical advice.
A swimmer experiencing pain, injury, illness or mental health concerns, or requiring specialist nutritional advice, should consult an appropriately qualified healthcare professional before changing their training or lifestyle.
9. Safeguarding and behaviour
I may refuse, suspend or end a session immediately if:
- I have a safeguarding concern.
- A participant behaves abusively, threateningly, discriminatorily or otherwise inappropriately.
- The session is being disrupted or is no longer productive.
- I reasonably believe continuing would be unsafe, unethical or inappropriate.
A session ended because of a participant's conduct will not be refunded. Information shared during a session is treated confidentially, but I may disclose it where required by law or where necessary to respond to a concern about a child or vulnerable person.
10. Recording
Nobody may record a session without the prior agreement of everyone taking part. If we agree to record a session, everyone will be told why, how the recording will be used and when it will be deleted before recording begins.
11. Liability
I will provide the service with reasonable care and skill. I am responsible for loss or damage that is a foreseeable result of my breach of these terms or failure to use reasonable care and skill. I am not responsible for loss or damage that is not foreseeable, for business losses, or for outcomes caused by inaccurate or incomplete information supplied to me or by decisions made independently after the session.
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Nothing in these terms affects your statutory consumer rights.
12. Personal information
I use personal information as described in the privacy notice. By making a booking, you confirm that information supplied about a swimmer or another attendee is accurate and that you are authorised to provide it.
13. Complaints
If you are unhappy with the service, email [email protected]. I will try to acknowledge the complaint within five working days and resolve it fairly.
14. General terms
If any part of these terms is found unenforceable, the remaining terms will continue to apply. A delay in enforcing a term does not waive it. These terms are governed by the law of England and Wales, and you retain any right under consumer law to bring proceedings in another part of the UK where you live.
